ULTIMATE ROLLERCOASTER "THRILLVILLE" GIVEAWAY Official Rules
No purchase is necessary to enter this drawing.
1. ELIGIBILITY. The "Thrillville" Giveaway ("Drawing") is sponsored by Ultimate Rollercoaster, LLC ("Sponsor"). The drawing is open to participants who, as of the entry date, are legal residents of the United States, and are at least thirteen (13) years old. The Drawaing is void in all other jurisdictions and where prohibited or restricted by law. Employees, officers and directors of Ultimate Rollercoaster, LLC and their immediate families (defined as parents, spouses, children, siblings, grandparents, and their respective spouses) are not eligible to enter. The Drawing, and any website pages and advertisements relating thereto, is intended for viewing only within the jurisdictions where the drawing is offered and participants must be present in the United States at the time they enter.
2. TIMING. The Drawing begins at 12:00 p.m. Eastern Time on November 7, 2006 and ends at 11:59 p.m. Pacific Time on November 30, 2006 (the "Entry Period").
3. HOW TO ENTER. There are two (2) ways to enter the Drawing: (1) Register as a member of the Ultimate Rollercoaster.com site and complete the online entry form. (2) Mail your entry via postal mail.
a. ONLINE ENTRY: Become a registered user of the Ultimate Rollercoaster.com web site and then complete the online entry form to enter the drawing.
b. MAIL-IN ENTRY: Hand print or type on a 3" x 5" index card your name, complete home address, phone number, email address, age (including year of birth), and mail in an envelope addressed to Ultimate Rollercoaster, 1100 Irvine Blvd #440, Tustin, CA 92782. All mail-in entries must be received during the Entry Period. Sponsor is not responsible for lost, late, stolen, incomplete, invalid, unintelligible, illegible, damaged, mutilated, altered, misdirected or postage-due entries, which will be disqualified. No facsimiles, photocopied or mechanically reproduced entries allowed. Use of any automated system to submit entries is prohibited and will result in disqualification.
c. FOR ALL ENTRIES: All entries become the exclusive property of Sponsor and will not be acknowledged or returned. By participating in the Drawing, each participant (and, if a minor, the minor and the minor's parent or legal guardian) fully and unconditionally agrees to be bound by and accepts these Official Rules and the decisions of Sponsor (including, without limitation, decisions regarding eligibility of entries, the selection of participants and winners, and the awarding of prizes), which are final and binding in all respects.
4. DRAWING. Sponsor will randomly select potential prize winners for the Drawing from among all eligible entries received. The drawings will be held on or about December 1, 2006.
5. ODDS; NOTIFICATION. There will be six (1) grand prize winner and (4) second-place winners. The odds of winning a prize will depend on the number of eligible entries received. Each eligible participant who is selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Potential winners will be notified by e-mail.
6. PRIZES. (1) Grand Prize Winner will win an XBox game console and a copy of the Thrillville game. (4) Second Place Winners will win a copy of the Thrillville game.
7. PUBLICITY. Except where prohibited by law, participation in the Drawing constitutes each winner's consent to use winner's names, for promotional purposes in any manner or media (including, without limitation, on the Internet), worldwide, in perpetuity, and without further payment, consideration or consent.
8. GENERAL CONDITIONS. Sponsor reserves the right, in its sole direction, to terminate, modify or suspend the Drawing if, in Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Drawing, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties, acts of God or failures or any other factor beyond Sponsor's reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Drawing. In such event, Sponsor reserves the right in its sole discretion (but does not have any obligation) to award any or all prizes within any or all prize pools at random from among eligible, non-suspect entries received up to the time of suspected impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Drawing or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of this Drawing is a violation of criminal and civil laws, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
9. RELEASE. By entering, each participant forever and irrevocably releases and holds harmless Sponsor and its parents, subsidiaries and affiliates, and their respective agents, advertising and promotion agencies, affiliates, Drawing partners and prize suppliers, and all of their respective employees, officers, directors, shareholders and agents from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from participant's participation and/or entry in the Drawing and/or participant's award, receipt or use of any prize awarded in the Drawing.
10. LIMITATIONS OF LIABILITY. Sponsor is not responsible for: (a) incorrect or inaccurate transcription of entry information or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, incomplete, misdirected or postage due entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the entry process or the Drawing; (e) printing, typographical, electronic or human errors which may occur in the offer or administration of the Drawing or the processing of entries; or (f) any injury or damage to persons or property, including but not limited to participant's computer, which may be caused, directly or indirectly, in whole or in part, from participant's participation in the Drawing, or from viewing, playing or downloading any material from Sponsor's website(s), regardless of whether the material was prepared by Sponsor or a third party, and regardless of whether the material is connected to Sponsor's website by a hypertext link.
11. DISPUTES. Participant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Drawing, or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in New York, New York; participant submits to sole and exclusive personal jurisdiction to said courts in the State of New York for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Drawing but in no event attorneys' fees; and (c) under no circumstances will participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant or Sponsor in connection with the Drawing shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of California, United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
12. DATA COLLECTION. Sponsor collects personal information from participants when they enter the Drawing for use in administration of the Drawing. When entering at the Drawing' website, you may be asked to consent to receive promotional emails and information about Sponsor. Consenting to receive such emails is necessary to enter this Drawing. The information collected is subject to the Privacy Policy of Sponsor located at http://www.ultimaterollercoaster.com/info/privacy.shtml.
13. OFFICIAL RULES. These Official Rules are available at the Drawing website at www.ultimaterollercoaster.com/thrillville/rules.shtml or by writing to Ultimate Rollercoaster, LLC, 1100 Irvine Blvd #440, Tustin, CA 92780.
14. WINNER'S LIST. Beginning on or about January 15, 2007, you can obtain the name, city and state of each prize winner by sending a self-addressed, stamped envelope to Ultimate Rollercoaster, LLC, 1100 Irvine Blvd #440, Tustin, CA 92780.. Residents of Vermont need not affix return postage. Requests received after March 1, 2007 will not be honored.
