The real question is if before doing the maintenance work did he notify the ride operators that he was doing maintenance work on the coaster?
Now if the ride operators knew that he was doing maintenance work & they dispatched the train anyways then the ride operators are at fault.But then i have to agree that he is a little bit at fault too for working on the coaster without making sure that the ride was shut down first.But the real question is weather the ride operators knew that he was working on the coaster or not.If the ride operators knew that he was there doing maintenance work then they can face murder charges for dispatching the train if they knew that he was there.

Maintenance on an operating ride? Not as unusual as you would think. While it was unthinkable at Busch, I've seen several coaster behind-the-scenes where the maintenance was "showing off" their ability to complete minor work while the coaster is operating (I remember one where a guy was doing something under the Santa Cruz Dipper? while the train was roaring overhead.)

You have to remember that the rest of the world does NOT operate rides and have the same stringent policies for parks and what not that we have here in the United States.
Not justifying what happened, but as Kevin mentioned they don't have "Lock Out Tag Out" (LOTO) in Japan.
Maybe this is a common practice in Japan?
Who knows?
We shouldn't be so quick to judge.
